"You" means the person buying or using our products. If you are entering into these Terms on behalf of a company, you confirm you have authority to bind it.
By accessing this website, submitting your email address, purchasing a product, or joining a program or community, you accept these Terms, our Privacy Policy, our Refund & Cancellation Policy and our Earnings & Results Disclaimer. Together these form the entire agreement between you and us.

Access to paid products is delivered through third-party platforms — principally Whop — and is personal to you and non-transferable.
Unless a specific product page states a fixed access period, access to one-off purchases is granted for as long as we continue to operate that product, and access to subscription products lasts for as long as your subscription is active and paid.
Prices are shown on the relevant product or checkout page and, unless stated otherwise, are in US dollars. Payments are processed by our third-party payment providers (Whop and its underlying payment processors). We do not receive or store your full card details.
If a price is displayed with an obvious error (for example, a clear typographical mistake), we may cancel the order and refund you in full rather than honour the incorrect price.
AI Marcel is a recurring subscription. It is billed at US$39 per month and renews automatically each month until you cancel. You can cancel at any time from your account on the platform where you subscribed, or by emailing support@marcelfernandes.net.
Refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. In short: a 7-day unconditional refund window on the specific program you bought, plus a 60-day conditional guarantee for students who complete that program, personally book at least 20 qualified prospect calls using what it teaches, and can show the work. Full conditions, exclusions and how to claim are set out in that policy.
All course content, videos, recordings, written materials, scripts, templates, frameworks, software, branding, trade marks and website design are owned by us or our licensors and are protected by copyright and other laws.
When you purchase, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the materials for your own personal and internal business use, for as long as your access lasts.
You may not:
If you post content into our communities (messages, wins, screenshots, questions, feedback), you keep ownership of it, but you grant us a worldwide, royalty-free, perpetual licence to use, reproduce and display it for the purpose of operating, moderating and promoting our programs — including as anonymised or first-name-only testimonials. We moderate at our discretion and may remove content or members. Removal for a serious breach does not entitle you to a refund.

"Unlimited" conversations means unlimited ordinary personal use. We may apply reasonable rate limits to prevent automated, abusive or commercially resold use.
We do not guarantee any income, profit, or business result. Testimonials and figures shown on this website are the individual experiences of specific students and are not typical and not a promise of what you will earn. Your results depend on your effort, skill, market, timing and many factors outside our control. Our services and materials are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions and representations not expressly set out in these Terms — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the services will be uninterrupted, error-free, secure, or that any particular content, feature, bonus, live session or community will always be available.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded — including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or your non-excludable rights as a consumer under the law of your country of residence.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, business, goodwill, opportunity, data or anticipated savings, however arising, even if we were advised such loss was possible.
Our total aggregate liability to you for all claims arising out of or relating to our services is limited to the total amount you actually paid us in the twelve (12) months immediately before the event giving rise to the claim.
You accept that any business you build is your own. We are not liable for decisions you make, agreements you enter into with your own clients, or losses your business incurs.
You agree to indemnify and hold us, our manager, officers, staff and contractors harmless from any claim, demand, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of our materials, or your own business activities and dealings with your clients.
We may update these Terms to reflect changes to our products or the law. The current version is always published on this page with an updated "Last updated" date. Material changes take effect for existing customers no earlier than 14 days after we publish them, or when you next purchase or renew — whichever comes first. Continuing to use our services after that means you accept the updated Terms.
These Terms and any dispute arising out of them are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, and the courts of Dubai, U.A.E. have exclusive jurisdiction — except where you are a consumer resident elsewhere and the mandatory law of your country of residence gives you the right to bring proceedings in your local courts or to rely on your local consumer protections. Those rights are not affected.

If any provision of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.

We have not appointed a Data Protection Officer, as we are not required to. Privacy requests are handled directly by our team at the address above.
This policy covers marcelfernandes.net and any page, form or product we operate that links to it. No system is completely secure. If a breach occurs that is likely to result in a risk to your rights, we will notify you and the relevant supervisory authority as required by law.

We publish student results, quotes, screenshots and video testimonials on this website and on marcelfernandesreviews.com.
If you subscribe to AI Marcel, the messages you send are transmitted to a third-party AI model provider so a response can be generated, and are stored so your conversation history works. We may review conversations in aggregate or anonymised form to improve quality and detect abuse.
Do not enter passwords, payment card details, government ID numbers, health information, or other people's personal data into AI Marcel. You can ask us to delete your conversation history at any time.
Our products are for adults. We do not knowingly collect personal data from anyone under 18. If you believe a child has given us personal data, contact us and we will delete it.
We will update this page when our practices change. The "Last updated" date at the top always reflects the current version. If a change materially affects how we use your data, we will notify you by email or a prominent notice on the site.

If you are in the EEA or the UK and you are not satisfied with how we have handled your data, you have the right to complain to your national data protection authority — in the UK, the Information Commissioner's Office. We would appreciate the chance to resolve it with you first.

We want you in the program because it's right for you — not because you feel stuck with it. This policy sets out exactly when you can get your money back, what you need to show, and how to ask. It forms part of our Terms & Conditions.
Days 1–7 — change your mind, no questions asked. Ask within 7 days of purchase and we refund you in full. You don't have to give a reason.
Days 8–60 — the action guarantee. If you finished the program, personally booked at least 20 qualified prospect calls using what it teaches, and it still didn't work for you, we refund you — provided you can show us the work. The conditions are in section 3, and we apply them as written.
After day 60 — no refund, other than any right you have under the mandatory consumer law of your own country.
For the specific program named at checkout or on your receipt, you may request a full refund of what you paid for that program within 7 calendar days of your purchase for any reason or no reason at all.
Just email support@marcelfernandes.net from the address you bought with and say you'd like a refund.
Between day 8 and day 60 after purchase, we will refund you in full if you genuinely worked the program and it did not produce a result for you. This is a conditional guarantee: it exists to protect students who did the work, and it is not a 60-day free trial.
A qualified prospect call is a real call you booked with a potential customer who reasonably fits the kind of customer that program teaches you to work with.
A booking still counts if the person later cancels or does not show up, as long as the booking and the outreach behind it were genuine.
These do not count: test bookings, duplicates, calls booked before you purchased, friends or family standing in as prospects, bookings that were bought or made up, spam, and anything else that is not a genuine booking.
To be clear about what we are not asking for: we do not require 20 calls that actually took place, we do not require any sales, we do not require you to have earned money, and we do not require any number of messages sent.
We review each claim honestly and in good faith, and we err on the side of the student when the evidence is close. But we do check. If something is missing from your evidence, we will tell you exactly what is missing and give you a fair chance to send it. We are not looking for a technicality to say no.
If your claim is approved, we refund what you paid for that program and your access to it ends.
Subscription products work differently, because you're paying month to month rather than once for a program.

We acknowledge every request within 3 business days and give you a decision within 10 business days of receiving everything we need.
Approved refunds are issued to the original payment method, in the original currency, through the platform you purchased on. We cannot refund to a different card, account or person.
Once we issue a refund it usually reaches you within 5–10 business days, though your bank sets the final timing. Because of exchange-rate movement between purchase and refund, the amount that lands in your account may differ slightly from what you paid. That difference is your bank's, not a partial refund.
Nothing in this policy limits rights you have under the mandatory consumer law of your own country. Where your local law gives you more than this policy does, your local law wins.
Consumers in the EU and UK: you normally have a statutory 14-day right to withdraw from a distance contract. For digital content supplied immediately, that right can be lost once supply begins — but only if you expressly consented to immediate access and acknowledged that you would lose the right. Where that has not validly happened, your statutory 14-day withdrawal right applies in place of, and in addition to, our 7-day window. Tell us you are exercising it and we will refund you without requiring any conditions.
Please talk to us before disputing a charge with your bank. We answer every email, and a refund we issue directly reaches you faster than a chargeback does.
Where a chargeback is raised without contacting us first, we will respond to the dispute with our records of your purchase, access and usage. Fraudulent chargebacks — for example disputing a charge after completing the program — may result in permanent loss of access and may be referred for recovery.
